First, you face the Criminal Penalty: a fine between 50% and 200% of the tax evaded, and potentially up to 5 years in prison. 

Second, you face the Civil Penalty: you still have to pay the original tax owed, plus the CRA’s massive civil interest and late-filing penalties. Essentially, the government can take everything you own and still send you to jail.

Can I go to jail for a tax mistake in Canada? 

No. Mistakes are civil matters. Evasion requires proof that you intended to deceive the government.

Is it tax evasion if I didn’t file at all? 

It can be. While failing to file is a separate offence, doing so to hide large amounts of income can be prosecuted as evasion.

How far back can the CRA look? 

In a criminal fraud or evasion case, there is essentially no time limit. They can reopen decades-old files if they suspect “wilful default.”

What is the difference between “Gross Negligence” and “Tax Evasion”? 

Gross negligence is a civil penalty applied when the CRA thinks you were extremely careless but didn’t necessarily intend to commit a crime. Tax evasion is a criminal charge where the Crown must prove you intentionally broke the law. The difference often comes down to the evidence of a “cover-up” — falsified books vs. messy books.

Can I still use the Voluntary Disclosures Program (VDP) if I suspect I’m being watched? 

The VDP is only an option if your disclosure is “voluntary.” If the CRA has already started an audit or investigation into your file, you are likely ineligible. However, if they haven’t contacted you yet, a VDP application can grant you total immunity from prosecution.
