Know your rights!

Have you recently been contacted and/or arrested by the police? First and foremost, one must consider everything that they intend to share with the officer in charge of the the investigation.

Just a quick piece of important detail that cant be overlooked, the police can legally stop you and approach you to ask questions. If arrested or detained by police, you do not have to answer their questions, and you should refrain with discussing the incident with the police in hopes that the charge will go away.

“But Kazandji, what if I want to tell them what actually happened?” I would strongly advise you hold off; you will have your moment to share with facts at trial. Anything you share with the officers may be used against you in trial, therefore one thing to remember “LESS IS MORE”.

By law and in accordance with the Canadian Charter of Rights and Freedoms, you have the right to remain silent. Furthermore, you have the right to be informed about what is happening, and most importantly- you have the right to speak with a lawyer. However, there are exceptions. Upon arrest, you must provide the police with details such as: your name, address and date of birth. Additionally, if the arrest pertains to a motor vehicle incident, the Traffic Safety Act requires that you provide information with regard to the vehicle(s) involved and details on the incident. Furthermore, if you are involved in a regulated activity such as hunting, by law you must provide information which pertains to the activity.

Remember, anything in which you state to the police- is collected as evidence and can be used against you in a court of law. Going forward, just remember to REMAIN SILENT.
